Forest Centre
These are the Terms and Conditions of the Forest Centre, a trading
name of Marston Vale Services Limited (registered company number 3538255)
whose registered office is at 136-140 Bedford Road, Kempston, Bedford
MK42 8BH (Forest Centre).
These Terms and Conditions apply to all venue and conference facilities,
all course bookings and services (referred to as "facilities",
"course" or "event") provided to any client (the
Client).
1. Booking and Payment
1.1 These terms and conditions apply to all bookings made by the
Client with the Forest Centre for any course. These terms and conditions
apply to the exclusion of all other terms and conditions.
1.2 Any verbal booking made by the Client is provisional until confirmed
by receipt of the Forest Centre's booking form duly completed by the
Client. Unless the booking form is received within 5 working days
of booking, the Forest Centre reserves the right to release the provisional
booking and re-sell the facilities.
1.3 The price for provision of the services by the Forest Centre
is set out in the price list supplied by the Forest Centre. All prices
exclude VAT. All invoices are due and payable within 14 days of invoice
date.
2. Amendments
2.1 The Client must confirm delegate numbers, timings and any special
requests in relation to any course in writing to the Forest Centre
at least 7 working days prior to commencement of any course.
2.2 If the Client wishes to cancel or postpone any booking without
charge, it must do so in writing giving no less than 12 weeks notice.
If such notice is not received, the following scale of charges will
apply:-
2.2.1 If notice is received less than 12 weeks but more than 8 weeks
before the event, the Forest Centre will be entitled to charge 25%
of its total fee for that event.
2.2.2 If notice is received less than 8 weeks but more than 14 days
before the event, the Forest Centre will be entitled to charge 50%
of its total fee for that event.
2.2.3 If notice is received less than 14 working days but more than
7 working days before the event, the Forest Centre will be entitled
to charge 75% of its total fee for that event.
2.2.4 If notice is received less than 7 working days before the event,
the Forest Centre will be entitled to charge 100% of its fee for that
event.
3. Services Provided by the Forest Centre
3.1 The Forest Centre will provide the conference services appropriate
for any course or event with professional care and skill.
3.2 If the Client requires additional facilities or equipment it
must give the Forest Centre at least 28 working days notice to ensure
availability.
3.3 The Forest Centre offers a safe facility in accordance with approved
Health and Safety Guidelines and complies with all appropriate licensing
and statutory regulations.
4. Obligations of Client
4.1 The Client must ensure that delegates arrive and vacate on time.
Whilst the Forest Centre will endeavour to accommodate extended provision
of services, it cannot guarantee to do so and will make additional
charges where it does so.
4.2 The Client must notify the Forest Centre in advance and obtain
the Forest Centre's approval of any external entertainment, services,
activities, musicians required by them to attend at any course. The
Forest Centre reserves the right to make additional charge where appropriate.
4.3 The Forest Centre provides appropriate food and beverages for
all delegates and neither the Client nor its delegates may bring any
of their own food and beverages into the Forest Centre.
4.4 The Client and its delegates will at all times comply with the
Forest Centre's Health and Safety Regulations and other appropriate
licensing or statutory regulations.
4.5 The Client and its delegates must obtain the Forest Centre's
prior written approval before affixing items to walls, floors, ceilings
or furniture. The cost of repairing any damage caused to the Forest
Centre, its contents or its grounds by the Client or its delegates
will be charged to Client.
5. Liability
5.1 The Forest Centre accepts liability without limit in respect
of death or personal injury to any Client delegate whilst at the Forest
Centre occasioned as a result of the negligence of the Forest Centre
or any of its employees.
5.2 The Forest Centre accepts no responsibility for direct, indirect
or consequential loss or damage to property occurring to the Client
or any of its delegates. In particular, the Forest Centre does not
accept responsibility for loss or damage to the property and vehicles
of the Client, its delegates or visiting guests however caused.
6. Cancellation or Exclusion by the Forest Centre
6.1 If the Forest Centre is unable to fulfil the booking for any
course it may offer alternative facilities to the Client.
6.2 In the event of poor behaviour or activities unacceptable to
the Forest Centre on the part of any Client delegate or guest, the
Forest Centre reserves the right to exclude such person and/or terminate
the course. In this eventuality no money will be refunded. The Manager
of the Forest Centre is responsible for the health and safety of all
of those at the Centre and his decision is final.
6.3 The Forest Centre may cancel any course booking if in the absolute
discretion of the Manager such booking would adversely prejudice the
reputation of the Centre or if the Client has failed to make any payments
due to the Forest Centre by more than 30 days from due date but subject
to the Forest Centre having first served 7 days notice in writing
to the Client of its intention to operate this provision.
7. Force Majeure
7.1 The Forest Centre shall have no liability in respect of any delay
or failure in performing any obligations to the Client due to any
cause of whatever nature outside the reasonable control of the Forest
Centre or its suppliers.
7.2 The Forest Centre will promptly notify the Client of the occurrence
of such an event of force majeure and the obligations of the Forest
Centre will be suspended for the duration of such force majeure event.
8. Law
This Agreement shall be governed by and interpreted in accordance
with English law and subject to the exclusive jurisdiction of the
Courts in England and Wales.
